The Beneficiary has the right to withdraw from the Agreement within the first 14 days from the conclusion of the Agreement by submitting an unequivocal statement in which he/she expresses his/her decision to withdraw from the Agreement.
By way of exception , the Beneficiary cannot withdraw from the Agreement after the full performance of the services, if the execution of the Agreement has begun with the prior express consent of the Beneficiary and after he/she has confirmed that he/she has become aware of the fact that he/she loses his/her right of withdrawal after full execution of the Agreement by the Provider. If the Beneficiary decides to exercise his/her right of withdrawal according to this Chapter 6 – Right of withdrawal and according to the law, the Provider will reimburse the Beneficiary all the amounts it received as payment from the Beneficiary, without undue delay and, in any case, no later than 14 days from the date on which it is informed
By exception, if the Beneficiary exercises his/her right to withdraw from the Agreement after the Provider has started the execution of the Agreement, and the Agreement has not been fully executed, the Beneficiary will owe payment for the services already provided with his/her express consent and if these have already been paid on the withdrawal date, the respective amounts will not be reimbursed by the Provider.
The Beneficiary expressly gives his/her prior and express consent for the Provider to start executing the Agreement from the date of its conclusion and declares and confirms that he/she is aware, understands and agrees that he/she will lose his/her right of withdrawal after the full execution of the Agreement by the Provider. Also, the Beneficiary declares and confirms that he/she is aware, understands and agrees with the fact that in the event that he/she exercises his/her right of withdrawal according to the law, before the Provider has fully executed the Agreement, the Provider will not be held liable to return the amounts paid for the services that will have already been provided by the Provider and if at that date the respective services have not already been paid, the Beneficiary will owe their payment.
